We only collect publicly available data from professional sources such as LinkedIn, GitHub, Stack Overflow, or other career websites, and we never process sensitive personal categories such as religious views, political opinions, biometric data, or health information. All automated searches we perform are paired with human oversight, and no recruitment decisions are made without a person reviewing the candidates.

To prepare for future regulations, we follow GDPR principles, including data minimization, storage limitation, and accuracy checks, revising all personal data in our systems at least twice a year. Candidates can exercise their rights to access, correct, delete, or limit processing of their personal data, and we provide clear instructions for doing so. We are moving toward a model where holding data without explicit consent is not just a compliance risk but a toxic asset. The future of recruiting will not be about who has the biggest database, but who has the cleanest data lineage.

This shift forces us to rethink the architecture of our sourcing. Right now, I am systematically auditing our vendors to understand exactly how they acquire candidate profiles. If an AI tool serves up a perfect passive candidate, I need to know if that data was scraped in violation of terms or privacy expectations. We are effectively transitioning from a hunter-gatherer approach to a permission-based ecosystem. The immediate step I am taking is decoupling our internal talent pools from third-party aggregators that cannot prove consent. It is painful to shrink our reach intentionally, but building a talent strategy on borrowed data is building on sand.

I’ve been drafting and negotiating employment contracts since 1983, and here’s what I’m seeing right now: data privacy regulations are forcing employers to rethink what information they actually *need* during recruitment versus what they’ve always collected out of habit. I just reviewed a client’s application forms last month that asked for Social Security numbers upfront–completely unnecessary and a massive liability exposure.

The specific step I’m implementing with clients is what I call “staged information collection.” We restructure their hiring process so sensitive data only comes in after a conditional offer is made. Background check authorizations, salary history (where still legal), references–all of it waits until you’ve decided this person is your choice. This cuts your data exposure by roughly 80% because you’re not sitting on sensitive information for dozens of rejected candidates.
